Philippines đưa tranh chấp Biển Đông ra Đại Hội Đồng Liên Hiệp Quốc

Tin cập nhật về Vận Động thế trận quốc tế hóa tranh chấp Biển Đông chống bá quyền Trung Quốc.

Thứ nhứt là Ngoại trưởng Philippines Albert Del Rosario sẽ đưa tranh chấp Biển Đông ra trước Đại Hội Đồng LHQ vào ngày Oc 1, 2012.

Thứ hai là Phiên họp nới rộng ngày Oct 5, 2012 của Expanded ASEAN Maritime Forum về Biển Đông tại Manila.

Có vài dấu hiệu về thành quả của công việc vận động mà Nhóm Freedom of Navigation Advocate Group (FNAG) đã khởi động từ cuối tháng Bảy, 2012.  Philippines và Hoa Kỳ đã nhận và lưu ý đến đề nghị của FNAG.  Xin gởi đến quí vị tin cập nhật với một vài nhận định:

1)  Nếu Đại Hội Đồng LHQ ngày Oct 1 chỉ thông qua một lập trường tổng quát yêu cầu các phe tranh chấp giải quyết theo đường lối hòa bình thì Ngoại Trưởng Del Rosario chưa đạt tới điều mong mỏi là "Lấy ý kiến Tư Vấn của Tòa Án Quốc Tế (Advisory Opinions of the International Court of Justice ICJ)" mà Nhóm chúng ta Freedom of Navigation Advocate Group (FNAG) chủ trương để cắt Đường Lưỡi Bò của bá quyền Trung Quốc.  Tôi hy vọng là Ngoại Trưởng Del Rosario sẽ đủ khôn khéo để có được một Nghị quyết (Resolution) thông qua của ĐHĐ LHQ trong đó có đề cập lấy ý kiến tư vấn của ICJ.  Sau ngày Oct 1, tôi sẽ tường trình thêm về nội dung bài thuyết trình của Ngoại trưởng Del Rosario.  Có nhiều hứa hẹn sôi nổi đưa đến sự nhục nhã và phơi bày bộ mặt trân tráo của bá quyền Trung quốc.

2)  Ngoại trưởng Del Rosario, và bà Hillary Clinton đã nhóm họp với các ngoại trưởng khác của khối ASEAN đến tham dự phiên 67th của ĐHĐ LHQ.  Điều này cho thấy có thể có một hành động nhất trí cùng theo đuổi một mục tiêu chung là "đánh bại Đường Lưỡi Bò" trên phương diện pháp lý. Nếu Del Rosario và Clinton hành động như dự kiến trong "script" của FNAG thì là một điều vô cùng ngoạn mục và thú vị.  FNAG đã vạch ra một thế trận và chúng ta ngồi chờ các diễn biến tùy thuộc vào các sắp xếp bên trong hành lang ngoại giao của các nước.  Ván bài ngoại giao của Del Rosario có thể không hiệu quả nếu ông ta quá chú trọng đến khiá cạnh tranh chấp biển đảo territorial dispute.  Như chúng ta đã phân tích,  thế trận này là môt tiến trình 2 giai đoạn, mà ĐHĐ LHQ là một diễn đàn để dựa vào đó lấy Nghị quyết về Ý kiến Tư Vấn của ICJ.

3)  Ngày Oct 5 sẽ có một phiên họp đầu tiên của Expanded ASEAN Maritime Forum tại Manila, phải chăng đây là một chuẩn bị về một thế đánh thứ hai nhằm vào the International Maritime Organization (IMO) như là một cơ chế thứ hai (thay vì ĐHĐ LHQ) để lấy Ý kiến Tư vấn của ICJ? Nói chung là FNAG rất khích lệ về các nghị trình rất tích cực của The Philippines. hãy chờ xem.

Con đường chống bá quyền Trung quốc còn nhiều thử thách và gian nan.  Sự tiếp tay ủng hộ của quí vị là một khích lệ lớn.  Mong luôn có đựợc sự gắn bó cho đại nghĩa. Ước mong nhận được ý kiến phản hồi của quí vị nhằm giúp Philippines có thêm con đường sáng.

The Philippines would raise the South China Sea territorial issue before the 192-member United Nations General Assembly (UNGA) in New York in October, Foreign Secretary Albert del Rosario said.

Del Rosario said the Philippines would press before the world’s largest diplomatic gathering the urgency of ensuring the peaceful settlement of the territorial dispute in accordance with international laws and without resorting to force or military threats.  China, the largest and most powerful among six claimants to disputed territories in the South China Sea, also known as the West Philippine Sea, has vehemently opposed any attempt to bring the issue to any international arena, much less to the UNGA, the most high-profile annual summit of world leaders.

Del Rosario would speak on Oct. 1 in lieu of President Aquino. He has also been invited by the current UNGA president to speak during the Sept. 24 UN high-level meeting on the rule of law.
“That will be a relevant portion,” Del Rosario told reporters late Thursday when asked if he would raise the territorial rifts in his speech during the UN conference.The territorial conflicts have flared up again recently after Vietnam and the Philippines separately accused Chinese vessels of intrusion, harassment of fishermen and disrupting oil exploration within their territorial waters starting last year.
Vietnam has protested what it called increasing Chinese aggression in the resource-rich waters when Beijing recently tendered bids for several gas and oil exploration areas within Hanoi’s waters.  In April this year, a standoff erupted between the Philippines and China when a Chinese warship prevented Philippine authorities from arresting Chinese poachers in the Scarborough Shoal, which Manila said was within its 200-nautical mile exclusive economic zone as provided by the United Nations Convention on the Law of the Seas (UNCLoS).

Both countries, along with 162 other nations, are signatories to the treaty.

China has long held the position of resolving the disputes by negotiating one on one with each of the rival claimants, an arrangement critics say would give it advantage because of its sheer size and power.

The Philippines, Vietnam, Malaysia, Brunei, China and Taiwan all have competing claims over parts or in whole of the strategic waters harboring vast oil and gas deposits.

Beijing, which claims the sea nearly in its entirety, has warned non-claimant countries like the US from intervening in what it has said was a purely Asian issue.

Many have feared the conflicts could be Asia’s next flashpoint. Washington has declared that it was in the US national interest to ensure that the territorial row are resolved without the use of force and intimidation and that freedom of navigation and the flow of commerce in the busy sea lane remain unimpeded.
